- Conversation data: SMS messages exchanged between Atlas and end users.
- Usage data: Information about how business clients configure and interact with the Atlas dashboard.
- Technical data: IP addresses, browser type, and log data collected automatically when you visit hivemindagency.ai.
Important — SMS Program Data Protection: All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, affiliates, or non-affiliated entities for their marketing or promotional purposes. Mobile opt-in data and consent is used solely to deliver the messaging service you opted into.

How Atlas SMS Works
Atlas is an AI assistant operated by HiveMind AI LLC that communicates via SMS with users who have opted in directly with us. End users provide express written consent through a single opt-in path:
- Web form opt-in: A user submits our contact form at hivemindagency.ai/try-atlas.html. The form collects name and email (both required) and offers two contact-preference options: "Email me only" (default) or "Email me and also text me from Atlas." Only users who explicitly select the second option, and who provide a US mobile phone number, are enrolled in the SMS program. Selecting the SMS option constitutes the user's express written consent to receive SMS messages. Users who choose "Email me only" receive only email and are never enrolled in the SMS program. SMS consent is voluntary and is not required to use the contact form or to receive a response from us.
Consent is collected specifically for this Atlas SMS program operated by HiveMind AI LLC. Mobile numbers and opt-in consent are never shared with, transferred to, or used by any third party, affiliate, or other entity.
SMS Program Terms (CTIA & TCPA Compliant)
- Program name: Atlas by HiveMind AI
- Message frequency: Variable — typically 2 to 6 messages per conversation. Atlas responds to your messages as you send them.
- Message and data rates may apply depending on your mobile carrier plan.
- Opt-out: Reply STOP to any message at any time to immediately unsubscribe. You will receive one final confirmation message and no further messages.
- Help: Reply HELP to any message for support information, or contact boris@hivemindagency.ai.
- Carriers: Supported on all major US carriers. Carriers are not liable for any delayed or undelivered messages.
- Consent is not a condition of purchase of any HiveMind AI product or service.
Mobile information and opt-in consent will not be shared with third parties or affiliates for marketing or promotional purposes. Mobile opt-in data and consent are used solely to deliver the Atlas SMS service you opted into.
How We Use Information
- Deliver and operate the Atlas AI service for you or on behalf of subscribing businesses
- Process billing and payments through our integrated payment platform
- Send transactional and service-related communications to business clients
- Improve Atlas using anonymized, aggregated conversation data (never individual end-user data tied to identity)
- Comply with applicable laws and respond to lawful requests
- Detect and prevent fraud, abuse, or security incidents
How We Share Information
We do not sell personal information. We do not share mobile opt-in data or mobile phone numbers with any third party, affiliate, or non-affiliated entity for marketing or promotional purposes. We share data only in the following limited circumstances:
- Service providers: We use Twilio (SMS infrastructure), GoHighLevel (CRM and payments), Anthropic (AI model provider), and cloud hosting providers. These vendors process data strictly on our behalf under data processing agreements and are contractually prohibited from using your mobile opt-in information for their own marketing or any purpose other than delivering the Atlas service.
- Legal compliance: We may disclose information when required by law, court order, or to protect the rights and safety of users.
- Business transfers: In the event of a merger, acquisition, or sale of assets, user data may be transferred as part of that transaction. In such a case, the successor entity will be bound by this privacy policy's restrictions on mobile opt-in data.
Data Retention
We retain business client account data for the duration of the subscription plus 90 days after termination. SMS conversation logs are retained for 12 months and then deleted or anonymized. You may request earlier deletion by contacting us.
Your Rights
Depending on your location, you may have the right to:
- Access the personal information we hold about you
- Request correction of inaccurate data
- Request deletion of your data
- Opt out of SMS communications at any time by replying STOP
- Lodge a complaint with a data protection authority
